You understand and agree that Hey Capto is not responsible for the security, privacy, or business practices of any third party.

To train, develop, validate, evaluate, fine-tune, and improve Hey Capto artificial-intelligence and machine-learning models, algorithms, scoring engines, datasets, and related products and services, subject to de-identification, aggregation, anonymization, contractual restrictions, and other privacy-protective measures where appropriate or required by law.
We may use your business contact information to contact you about Hey Capto products or services that may be of interest to you. We do not currently use personal information for third-party cross-marketing programs. You may opt out of marketing communications by following the unsubscribe instructions in our emails or by contacting us at privacy@heycapto.com.
We do not currently sell personal information or share personal information for cross-context behavioral advertising as those terms are defined under applicable U.S. state privacy laws. Hey Capto may create, license, sell, or otherwise commercialize de-identified, anonymized, aggregated, or statistical data that does not identify any individual or specific customer. If Hey Capto changes its practices so that it sells personal information or shares personal information for targeted advertising within the meaning of applicable law, Hey Capto will update this Privacy Policy and provide any opt-out rights required by law before doing so.
4. Retention and Transfer of Information
4.1 Retention of Your Personal Information and Data
The Company will retain your personal information and data only for as long as is necessary for the purposes set out in this privacy policy. We will retain and use your personal information and data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
The Company will also retain your usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our platform, or we are legally obligated to retain this data for longer time periods.
4.2 Transfer of your Personal Data
Your personal information and data is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. Your consent to this privacy policy followed by your submission of such information represents your agreement to that transfer, subject to any additional requirements for international users referenced in Section 4.3.
The Company will take all steps reasonably necessary to ensure that your personal information and data is treated securely and in accordance with this privacy policy and no transfer of your personal information and data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.
4.3 International Users
Hey Capto is based in the United States and may process information in the United States and other jurisdictions where Hey Capto, its affiliates, service providers, or customers operate. Those jurisdictions may have data protection laws that differ from the laws where you are located.
Where required for transfers of personal information from the EEA, UK, or Switzerland to the United States or other jurisdictions that have not been deemed adequate, Hey Capto will rely on appropriate transfer mechanisms, such as the Standard Contractual Clauses, the UK International Data Transfer Addendum, or other legally recognized safeguards.
Hey Capto is subject to the General Data Protection Regulation (EU) 2016/679 (“GDPR”) by virtue of its wholly owned subsidiary operating in Porto, Portugal, and through its processing of personal data of individuals located in the European Economic Area. Hey Capto has implemented, and continues to maintain policies, processes and controls designed to achieve and sustain GDPR compliance. Hey Capto transfers personal data from the EEA to the United States on the basis of Standard Contractual Clauses (“SCCs”) adopted pursuant to European Commission Decision 2021/914. Enterprise customers may request a copy of Hey Capto’s standard Data Processing Addendum, incorporating the applicable SCCs, by emailing privacy@heycapto.com. Hey Capto will execute a Data Processing Addendum with any customer whose processing activities require one under applicable law.
5. EU/UK/Swiss Data Protection Rights
If you are located in the EEA, the UK or Switzerland, the General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”), the UK GDPR or the Swiss Federal Act on Data Protection (as applicable) provides you with certain rights in relation to your personal information. For purposes of these laws, Hey Capto Inc. is the controller of your personal information unless your organization has separately specified otherwise. Hey Capto’s processing is based on one or more of the following lawful bases under Article 6 GDPR: (i) the necessity of processing for the performance of a contract; (ii) the necessity of processing for compliance with a legal obligation; (iii) the legitimate interests pursued by Hey Capto or by a third party (such as securing and improving the Website and developing analytical and AI capabilities); and (iv) where required, your consent. Subject to applicable law, you have the right to: (a) access your personal information; (b) request that we rectify inaccuracies; (c) request erasure; (d) restrict or object to our processing; (e) data portability; (f) withdraw consent at any time where processing is based on consent; and (g) lodge a complaint with the supervisory authority in your EEA member state, the UK or Switzerland. 6. Security of your Personal Data
We have implemented administrative, technical, and physical safeguards designed to protect personal information from accidental loss and unauthorized access, use, alteration, and disclosure. These safeguards may include access controls, authentication measures, encryption in transit and/or at rest, backup procedures, monitoring, incident-response processes, and vendor-security controls, as appropriate for the nature of the information and the services provided. Any specific security commitments for enterprise customers should be set forth in the applicable customer agreement or security documentation.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
The security of your personal information and data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information and data, we cannot guarantee its absolute security. Any natural or legal person who processes the data on behalf of the Company may have access to your personal information or data. These third-party vendors collect, store, use, process and transfer information about your activity on our platform in accordance with their privacy policies. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. In the event of a data breach affecting your personal information, we will notify affected users in accordance with applicable law and our internal incident response procedures.

Where legally required, you may also manage non-essential cookies through the Website cookie-preference center or other controls made available on the Website. If you disable or refuse cookies, some parts of the Website may be inaccessible or may not function properly.
Third-Party Advertising. Hey Capto does not currently disclose personal information to unaffiliated third parties for their own third-party advertising or cross-marketing purposes. Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to this designated address: privacy@heycapto.com. However, please know we do not currently sell data triggering that statute’s opt-out requirements.
8. State Privacy Rights
If you are a resident of a U.S. state with an applicable comprehensive privacy law, you may have certain rights in relation to the personal information we collect from you, subject to applicable thresholds, exemptions, verification requirements, and limitations. 9. Children and Use by Minors
The Website is intended only for use by adults 18 years of age or older. The Website is not directed to, designed for, or intended for use by minors, and Hey Capto does not knowingly collect personal information from minors. 10. Sensitive Personal Data Restriction
The Website is not designed to collect or process sensitive personal data.
